will server JAR and mods be released for public download?

I was curious if the aether server (.jar and mods, not the maps) will ever be put out for public use. E.G.: Me and a few friends want to play the aether alone with each other.

Couldn't you release it, if the server only runs in whitelist mode?

If he releases the code then others will use it and NOT abide that rule.
And also i believe the server is VERY CPU intensive
