Why the person who griefed me isn't banned?

iXi_Futile_iXi griefed my old place and stole things from me. It was determined by a mod/admin (zero, I think it was) and he admitted to it. Why is he still on the server? Just curious as to how you determine whether or not someone should be banned for griefing.
