The state legislature, not the national legislature. If the legislature wants the flag up there, it has the power to do so.

The civil war was fought by Southerners to defend their rights. They were getting their rights infringed upon by the government in Washington DC much like the British government had infringed upon their rights four score and seven years ago. This flag is what the breakaway government used to represent themselves and to defend their rights. I don't understand how it's ironic there.
